These Terms of Service apply to all contracts for the use of services offered by Formreichlab, particularly online courses and training offers in the field of AI-powered graphic design.
The contracting parties are Formreichlab (hereinafter "Provider") and the user of the services (hereinafter "Customer" or "Participant").
Deviating, conflicting, or supplementary general terms and conditions of the Customer only become part of the contract if and to the extent that the Provider has expressly agreed to their validity.
The presentation of courses and services on our website does not constitute a legally binding offer, but rather a non-binding invitation to the Customer to book courses.
By submitting a booking request via the contact form, the Customer makes a binding offer to conclude a contract. The Provider can accept this offer by sending an order confirmation via email or by providing course access.
The contract text is saved by the Provider and sent to the Customer in text form after conclusion of the contract along with these Terms of Service.
The Provider offers online courses and training materials on the topic of AI-powered graphic design. The specific scope of services is derived from the respective course description.
Course content is provided via an online platform. The Customer receives personal access to the booked courses.
The Provider reserves the right to adapt the content, structure, and scope of courses at any time, provided this is reasonable for the Customer and does not affect the essential contractual content.
The prices stated on the website are final prices and include statutory value-added tax.
Payment is made as agreed by bank transfer, credit card, or other offered payment methods.
For booking of individual courses, the course fee is due before the course begins. For subscriptions, billing occurs according to the selected billing period.
Consumers are entitled to a statutory right of withdrawal. For details, please refer to the withdrawal instruction on our website.
The right of withdrawal expires prematurely if the Provider has only begun executing the contract after the Customer's express consent and the Customer has simultaneously confirmed that they lose their right of withdrawal upon complete contract fulfillment by the Provider.
All course contents, materials, and resources are protected by copyright. Through booking, the Customer acquires only the right to personal use of the course contents.
The distribution, reproduction, dissemination, or public reproduction of course contents is not permitted without the express written consent of the Provider.
In case of violations of these provisions, the Provider reserves the right to take legal action and may block access to course contents.
The Provider is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
In case of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations), the fulfillment of which enables the proper execution of the contract and on whose compliance the Customer regularly relies.
Otherwise, the Provider's liability is excluded. This applies in particular to indirect damages, consequential damages, and lost profits.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Should individual provisions of these Terms of Service be or become invalid, this does not affect the validity of the remaining provisions.
Amendments and supplements to these Terms of Service require written form.
